Will of Edward Barton, Deceased

I, Edward Barton of the county of Wayne and State of Indiana being in health and of a sound disposing memory and mind but considering the certainty of death & the uncertainty of life & being desirous to settle my worldly affairs & thereby be better prepared to leave this world when it may please god to call me home do therefore make and publish this my last will & testament in manner & form following that is to say.

First, whereas I have heretofore given to my eldest daughter Lydia Clark all that I want of my estate both real & personal which I intend for her - I give her no addition thereto.

Second, I do hereby give and bequeath unto my eldest son Andrew Barton the north half of the north quarter of land of Section numbered one of Township No. fourteen of Range No. one west of the meridian line drawn from the mouth of the great Miami River with what I have heretofore given him I give to him the further sum of one hundred dollars to him and his heirs forever.

Third, In addition to what I have heretofore given to my next eldest son Levin Barton I give to him the further sum of fifty dollars & no more.

Fourth, I give and bequeath unto my next eldest daughter Anna Cornthwait the sum of one hundred and sixty nine dollars in addition to that which I have to her heretofor given to her & her heirs forever.

Fifth, whereas I formerly gave to my daughter Elizabeth Sparkling, now deceased, all the

William Barton the South East quarter & the south half of the north east quarter of land of Section No. one Township No. Fourteen of Range No one West of the meridian line drawn from the mouth of the great Miami River with the exception of five acres in the Said described land which I heretofore sold to Thomas Bell which said five acres is not to be affected by or included in this my bequest. In consideration of the property hereby given to my said son William & his heirs forever, I do hereby require him to pay the aforesaid bequests or gifts before mentioned that is to say to Andrew Barton one hundred dollars, to Levin Barton, fifty dollars, to Anna Cornthwaith, one hundred and sixty nine dollars & to Mary Wofson, one hundred dollars being aforesaid Sums that I have respectively be given to them as before stated to be paid to each of them by him the said William Barton at any time within five years from & after the time of my deceased and the remainder of my personal estate after paying my debts and funeral expenses I give to him my son William to him & heirs forever.

Eighthly & lastly, I do hereby constitute and appoint my son William Barton to be my sole Executor of this my last will and testament; hereby revoking all former wills and testaments heretofore made ratifying and confirming this to by my last will & testament. I witness wereof I heretofore set my hand and seal this 7th day of eighth month one thousand eight hundred & thirty four.
